ADA case dismissed against Aurora Policemen CU in CUNA/league litigation win

WASHINGTON, DC (July 16, 2019) — The U.S. Court of Appeals for the 7th Circuit dismissed a lawsuit against Aurora Policemen Credit Union citing alleged violations of the Americans with Disabilities Act (ADA) on Monday. Credit Union National Association (CUNA) partnered with the Illinois and Wisconsin Credit Union Leagues to file an amicus brief in the case.

“We’re encouraged to see another appellate-level victory in CUNA-League efforts to defend credit unions from legal actions that exploit a law protecting disabled Americans,” said CUNA President/CEO Jim Nussle. “CUNA will continue its engagement in the legal and regulatory arenas to find a permanent solution that ends the uncertainty in the statute while ensuring the protections in place under the ADA remain in place.”

The 7th Circuit agreed with the district court that the plaintiff has not suffered an injury-in-fact, which is required to establish standing. This is the second win for credit unions at the appellate level, the first coming in the Fourth Circuit.

Credit unions around the country have been hit with similar lawsuits due to confusion about whether the ADA applies to websites. This case marks an important milestone in the CUNA/League efforts to fight back against lawsuits that are exploiting a law designed to protect disabled Americans.
