OSHA withdraws vaccination and testing mandate

The Department of Labor’s Occupational Safety and Health Administration (OSHA) Tuesday withdrew its vaccination and testing emergency temporary standard (ETS), previously issued in November. Although OSHA has withdrawn the vaccination and testing ETS as an enforceable emergency temporary standard, the agency has not withdrawn the ETS as a proposed rule.

“OSHA strongly encourages vaccination of workers against the continuing dangers posed by COVID-19 in the workplace,” said the agency in its announcement.

Of note, the U.S. Supreme Court earlier this month blocked enforcement of the Biden administration’s COVID-19 vaccine-or-test mandate for workers at large businesses by a 6-3 vote. According to the Court’s opinion, the mandate is a “significant encroachment into the lives—and health—of a vast number of employees.”
